Racial School Assignment Update

The Supreme Court consideration of racial school assignment, last discussed here, is starting to generate more comment.

Following the points made in his excellent brief, linked above, Hans Bader asks on the CEI blog:

Should a school district that teaches that individualism is racism, that planning ahead is for whites only, and that only whites can be racists receive special deference from the courts when it chooses to use race in assigning students to schools?

The Solicitor General filed a brief supporting the petitioners here.

Howard Bashman has posted a brief by a group associated with the National Association of Scholars calling for the repeal of Grutter here.

Finally, David Armor, Stephan Thernstrom, and Abigail Thernstrom have filed an amicus brief for the petitioners that I hope to have a link for soon.
