I”ll Tell You What’s “Disturbing”…

Writing in The New Republic, John Judis argues that

What’s disturbing about Roberts is his consistent opposition, when serving as a Reagan administration official, to the rulings and legislation inspired by the civil rights revolution of the 1950s and ’60s.

Readers will not be surprised to hear that I am reassured, not disturbed, by Roberts’s early statements in opposition to busing, quotas, etc., and by his refusal to repudiate them. What I find disturbing is the abandonment by liberals of the principles of “the civil rights revolution of the 1950s and ’60s” that they had formerly championed.

For example, Judis writes that in the past Roberts “was eager to fatally weaken Title VI and Title IX, which forbade discrimination by institutions that receive federal money….” But let’s look, again (see here for a recent look — one of many — from which I quote), at Title VI:

No person in the United States shall, on the ground of race, color, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance. [42 U.S.C.

Say What?
