Dems Move To Remove Prohibition of “Discrimination” From Calif. Constitution

Anyone who still doubts that Democrats have no principled objection to discrimination based on race or ethnicity need look no further than Senate Constitutional Amendment No. 5, the Democrats’ pending proposal to amend the California constitution.

Here’s how it begins:

The California Constitution prohibits the state from discriminating against, or granting preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.

This measure would eliminate this prohibition on state discrimination or preference in the operation of public education.

Since the current California constitution’s prohibition of discrimination is little if anything more than a restatement of the non-discrimination principle embodied in the Civil Rights Act of 1964, and since that Act is at least a major rhetorical and occasionally legal obstacle to race preference policies, is there any reason to believe that if Democrats gains control of both the House and Senate in Washington they would not follow the lead of California Democrats and move to repeal it?

Probably the best (and maybe the only) reason is the well-founded suspicion (here a hope) that they don’t have the courage of their convictions.

    Won’t this be prohibited by the Supreme Court decision that said that States cannot repeal laws that ensure civil rights, the Roehmer decision regarding Colorado if I recall.
