Despite his occasional (and annoying) dicta about such things as the evils of the Patriot Act and “our anxieties about contemporary judicial threats to liberal achievements and initiatives” (our anxieties?), Prof. James Cobb of the University of Georgia has a useful and interesting article in the New Republic pointing out the limits of the currently fashionable gloss on the limitations of judicial reform.
