The Constitutional Court will today rule on a landmark, high-profile labour dispute in Cape Town and could redefine, or at least clarify, the legal issues allied to affirmative action and employment equity practices.
Lilian Dudley, the former interim head of health in Cape Town, is challenging the appointment of current head of health Ivan Toms, saying that she should have got the job because she is black, a woman and ideally suited to the job.
Toms is a white man with a high profile as an anti-apartheid activist. He was not available for comment yesterday.
